Obligation to Certify Proficiency in State Language as Violation of Prohibition of Collective Expulsion

Summary
After the full-scale invasion of Ukraine by the Russian Federation, the legislature of the Republic of Latvia adopted amendments to the Immigration Law. These amendments terminated the permanent residence permits that had been issued under a simplified procedure to citizens of the Russian Federation who were formerly Latvian citizens or non-citizens. To obtain further residence rights, they were required to demonstrate proficiency in the Latvian language. Given the extensive discussions because of these amendments, the aim of this study is to determine whether the requirement to demonstrate proficiency in the state language violates the prohibition of collective expulsion of aliens, as enshrined in the European Convention on Human Rights.
