Climate Neutrality as an Objective in Environmental Law

Summary
Climate change is giving rise to new objectives in environmental law. One of these objectives, set by the European Union, is climate neutrality which is guiding the development of other legislation at both EU and national levels. The courts also take this objective into account when adjudicating cases involving environmental law. However, even though the term “climate neutrality” is defined in the European Climate Act, climate neutrality does not have clear boundaries. In Latvia, too, the legislator is considering the possibility of defining climate neutrality in law. This article therefore provides an overview of the genesis of the term “climate neutrality” and the possibilities for defining it. The author concludes that the definitions proposed by the European Climate Act and the Latvian legislator are vague and puts forward several criteria that could help in defining it.
