Ethical Case Law for the Protection of Individual Rights

Summary
The aim of the article is to examine and analyse certain problematic issues regarding the relationship between law and ethics, the importance of argumentation in the application of law, the accessibility of decisions in the protection of individual rights, based on the findings of legal science and specific judgments in order to achieve the goal of law – justice. Law and ethics relate to the coordination of social relations and activities in order to make them more qualitative and safer. Due to the regulatory function, they often pass into each other and their boundaries in some cases are not easily distinguishable. When summarising arguments, the person applying the law should also name those arguments that explain the assessment. Counterarguments have to be convincingly refuted, showing the stages of the thinking process. It should be explained why the finding named by the parties is incorrect or unlawful, which in no way helps to reveal the content of the legal norm. The credibility of the court, its reputation, openness towards the public are the criteria that require careful consideration of restricting the accessibility of decisions. The unavailability of decisions is detrimental to research interest of law students and the entitlement of the individual to know their rights.
