Unlawful Conduct in Contract Law

Summary
Unlawful conduct as a prerequisite for the civil liability is an essential aspect of both tort law and contract law. It is recognised in Latvian legal doctrine that the concept of excuse as liability regime is applicable in contract law. However, the content of the concept of excuse has been viewed and addressed in different ways. In the author’s view, the concept of excuse in contract law should be interpreted broadly. This means that, according to the concept of excuse, excuses could be defined in law and in the contract, including absence of fault.
