Summary
The article is structured as an interdisciplinary, descriptive study. The doctrinal approach is used to examine the national criminal procedural framework and the principles underlying the case law of the European Court of Human Rights on remote criminal proceedings. Simultaneously, videoconferencing in criminal trials is examined through a sociological lens, using available secondary data. The author seeks to answer a descriptive question, i.e., how do remote criminal proceedings affect the right to a fair trial and perceived procedural fairness?
