The Right to Personal Autonomy in the Context of Modern Technologies

Summary
The article is dedicated to cyber tort, i.e. violation of personality rights in digital environment. New technologies, amongst other effects, increase the risk of violation of personal autonomy.
Despite of adopting new legislation acts on EU and national level that improves protection of person against violation of their right and legitimate interest, it still lags behind the new technological breakthrough. Especially generative AI presents an unknown challenge not only regarding protection of intellectual property rights, but also for safeguarding of our fundamental freedoms and rights.
It is important to create universal and technologically neutral legal regulation which provides reasonable and effective legal protection against a different type of cyber tort in the future.
Since substantial development or improvement of the Civil Law will require reasonable preparation and time, it will be necessary to amend Civil Procedural Law with regulation that provides protection of personality rights analogically to protection of intellectual property rights under Chapter 302.
