Summary
The author reviews the origins of the principle of the private autonomy in the framework of the basic norm (Grundnorm) concept. It is the view of the author that the private autonomy is derived from the fundamental norm of a democratic state and of the rule of law (Rechtsstaat). The principle of private autonomy is recognised to not only have a material aspect, but also a procedural aspect, and therefore it contains the rights of a person to enforce substantive claim also in part only. These rights are a manifestation of a state acting under the fundamental norm of the rule of law and of democracy.
