Summary
The article provides a scientific insight into the regulation of the preliminary contract in the Natural Law codes – the General State Laws for the Prussian States and the General Civil Code of Austria, which both had a certain impact on the Codification of Baltic Private Law of 1864 – the predecessor of the current Civil Law. The author presents an insight into evolvement of the understanding of preliminary contract in Prussian and Austrian legal doctrine during the 19^th century based on the positions articulated by legal scholars, highlighting common and distinctive characteristics.
