Summary
The article examines the legal implications of a third party performing an obligation under the Latvian Civil Law (CL), particularly in light of CL Article 1815. The author analyses two key issues: (1) whether a creditor can refuse to accept performance by a third party, and (2) under what conditions the third party may claim reimbursement (recourse) from the debtor. The article highlights practical scenarios, doctrinal debates, and comparative insights from European private law. The author argues that the current CL framework lacks clarity and suggests legislative amendments to better align with modern legal standards and ensure legal certainty.
