Praktiskās saskaņotības princips tiesību normu piemērošanas procesā

Principle of practical concordance in the process of the application of legal norms

Artūrs Šuspāns, Mg. iur.

Summary
This article examines the legal method called the principle of practical concordance. This legal method allows to resolve conflicts between competing general principles of law by ensuring that none is favored over another, thus granting all equal protection and its maximum effect. The principle of practical concordance, nevertheless, should be distinguished from other collision resolving legal method called the weighing and balancing method, as they aim for different outcomes. Despite their differences, the article demonstrates how both legal methods can be integrated within the Latvian legal system through sequential application.
