Functions of Competition Council in Supervision of Public Persons and Their Capital Companies

Summary
To ensure the implementation of the leading state-owned enterprise commercial activity concept, the Competition Council of the Republic of Latvia has been entrusted with overseeing that the operations of public capital companies align with the principles of market failure or strategic sector necessity. Additionally, the Council is responsible for maintaining competition neutrality in mixed markets. With several years having passed since the introduction of these regulatory functions, it is now essential to reassess the underlying concept of state-owned enterprises and evaluate the practical implications of the Competition Council’s oversight.
