Summary
Access to environmental information, including data, is recognised as a fundamental human right, closely linked to the right to life, health, and well-being. This article explores the legal framework governing environmental data accessibility in Latvia, emphasizing the challenges posed by vague terminology, inconsistent application of legal norms, and broad use of exceptions such as confidentiality. Particular attention is given to the legal status of emission data, which should not be classified as confidential according to EU and national law. The analysis highlights the importance of clearly defined procedures for assessing data requests, and the need to strengthen legal clarity to ensure public access to information vital for environmental protection and democratic participation.
