Restitution in Fiduciary Contracts

Summary
Latvian Civil Law and related private law instruments lack both a legal definition and a comprehensive regulatory framework for fiduciary contracts, as well as a general principle of restitution. Despite this legislative silence, legal theory acknowledges the existence of such institutions within the Latvian legal system. In practice, however, this normative gap frequently gives rise to uncertainties regarding the legal validity of fiduciary contracts and the foundation for restitution obligations. The author examines the legal nature of fiduciary contracts, analyses the rationale for restitution upon the termination of such legal relationships, and assesses the applicability of Civil Law provisions governing authorisation agreements to fiduciary contexts.
